Also want to know how to find the Trust it went into, etc. I'm getting the runaround from WF who says they are the 'investor'. My note is on MERS.

sent that letter. got a response that they are the investor (clear lie). as for all there Mers/securitization docs, they suggested i issue a subpoena, as that info is 'proprietary'...

they also offered me a free refi to get it out of Mers...lol

i need a way to get that info in another way! thanks!

Pro se quiet title action, ask the Court to accept your mortg pymnts. Forward to Bank that holds the wet ink copy properly assigned and without having been already paid by another offsetting investor, I'd guess.....

Plan on doing a refi within this week.... Current mortgage is with BofA. Should I call and ask some questions to find this stuff out? I wouldn't mind getting a free refi if mine is with MERS as well...

My mortgage has been through Frontgate to Countrywide and now BofA...

(Not trying to hijack this thread but I would like to get some more info before I make a move as well)

Dys, what size (amount)? If small, move forward, if above 300k, get a Lawyer. Either way, get a Lawyer.

Dys - If your mortgage is held by MERS, then the refi is in order to get you to sign the proper paperwork that doesn't at this moment exist. Refis are a trap.

I told my family members to just sit tight and don't refinance or sign anything or agree to anything. I still believe that there will be a class action lawsuit filed by the 50 state attorneys general that will include some mechanism through which homeowners (and not just those in foreclosure) can find out where their notes are.

Right now, they (the AGs) are still talking about getting all the parties (homeowners, banks, and investors) to the table to resolve this. I just saw the Ohio AG on FOX Business, and he was quite adamant that the banks have created this problem, have committed fraud, and need to cooperate with the AGs in order to resolve this. I assume they are putting pressure on the banks to cooperate (i.e., sing like canaries) while continuing to gather evidence. This is massive, and will likely take longer than we think it should.

So, my money is on the states. I hope and pray I'm right, because if the government steps in and lets the banks get away with this fraud, then property rights are over and we might as well be living in Venezuela.

Obviously, if you can afford a lawyer, then you can consider a quiet title lawsuit. But I'd be very concerned about getting a judge who doesn't understand this issue. I'd wait until this becomes a little more mainstream. Which I believe it will. Right now, the media (other than Dylan Ratigan) is attempting to keep the focus on foreclosures. They can try, but they won't be able to keep millions of paying homeowners quiet about this issue. People aren't going to suddenly think, "Oh well, I guess I'll just keep paying my mortgage like a good little sheep even though I don't know where the note is." It will come out. Be patient.

I think every homeowner should call their state attorney general's office every single day and urge them to go after the banks and NOT settle. Your attorney general works for you and should be focused on protecting property rights first and foremost.

I was going to say that, too. But then I had the thought that this whole mess is going to end up in a huge settlement where all the homeowners get refinanced, with a reduction in principle. My instinct tells me that if the banks WANT you to refinance now, then it's probably not in your best interest. Of course, I have no way of knowing, so each individual has to make up their own mind.

Just to share info, talked to WF again today, they say the "investor" in the note is Wells Fargo Mortgage Backed Securities. When I asked if the note is securitized, I get told about the investor. So I ask--does WFMBS own the note? No, we (meaning WF) have the note. So do you pay this 'investor' anything? What did they invest in? More runaround...

Wells Fargo Asset Backed Securities was a corp in Delaware until about 08 and they got their pants sued off. They securitized buttloads. I'm sure my mortgage was securitized by them, but EDGAR filings only give generals about loans...

Filed a formal complaint with OCC to find out if loan was securitized. I'm sure it was but WF is really playing hide the salami...

Any suggestions appreciated

My tthoughts;

1 Get 2 quotes on your own title ins. not just the mortg co.'s policy, your own..

2 i think Jan '11 will be a better time for two reasons a lower rates after qe2 b more clarity as to mers et al...

3 file a claim as to 'who holds my mortg' before refi'g. Maybe it would 'survive' the refi (not sure tho)

4 get a lawyer.

5 I will post a series of ways to address that, but am unable to this hr. but i will - be patient grasshopper..
