If I ever have to send a payment by mail to anyone I always send by certified mail. You then have proof that the payment was sent and if you get a signature confirmation as well then you know exactly who received it. I did this once for an insurance payment. Ha, it was great to hear the insurance guys voice when he called to say the payment was never received. It was great telling him that I had the postal receipt that Miss bla bla had signed for it. Next thing I knew everything was fine. Cost about $4.

Wonder if they could prove that ****i treated their loan differently than others in Sylmar who were behind in their mortgage payments to ****ibank, or if they could, if it would matter to the California courts.

Or is it just about being on a house with equity like flies on ****...

when you do online banking, you can set up a recurring, monthly payment. as soon as the check clears your bank, you get a nice little "c" in the cleared column.

GUESS WHAT YOU ARE A FREAKIN IDIOT.

Bernstein insists a series of accidental missed payments led to foreclosure.

“My bank got bought out and my automatic payments got shut off without my knowing, then the mortgage owner then sends a notice I am behind. “

Are you freakin that stupid? Do you go to the ATM, and it says you have $1000.00 and withdraw half of it knowing you just wrote a check against it? ****ing lame as hell.

Bernstein says he worked out a repayment plan with Citibank. The bank confirms Bernstein made the first payment of $4,000 in January.

OK NOW HE KNOWS.... The fact that he had more money in his checking account wasn't a freakin clue.... DUMB ASS. PAY THE ****ING BILL

But what happened to the second payment is in dispute and the subject of a lawsuit.

How can it be a lawsuit... get a copy of the check, see who endorsed it, have it tracked.... It aint rocket science...

Don't bet on it. I just went through this with one of my properties. I was in disagreement with the bank about doing a short sell. They were opposed. I needed to get out of the mortgage on it as I was falling behind. What they actually did was wrote me a check for previous months of mortgage that I paid. Payments that they actually had cashed.

My guess is this family made the other payment, but will open their mail any day now and find a check written to them as a returned payment. They will say that the payments were returned as it didn't bring the mortgage current.
