But they didn’t realize another citizen was video recording the altercation from across the street.

And thanks to Craig’s List, Buehler was able to track that witness down. Now the Austin Police Department is forced to explain itself to the media why there are discrepancies in their version of the story.

According to KVUE:

The officer accused Buehler of spitting in his face. Buehler denies it. Buehler put an ad on Craigslist for anyone who may have witnessed the incident. Someone responded and provided video which appears to support Buehler's version of events.

Austin police disagree.

"Buehler was in the officer's face," said Corp. Anthony Hipolito, an APD spokesman. "The officer kind of put his hand on his shoulder and tried to back him up and at that time was when Buehler spit in the face of Officer Oborski. At that time he was placed under arrest for harassment of a public servant which is a third degree felony."

"I want to see both cops reprimanded, disciplined, maybe even fired," said Buehler. "I saw a woman getting assaulted by the police. It looked like police abuse, and I decided to speak up and take pictures. I think that is every person's right."

Buehler says there was a female who witnessed the altercation and offered to give Buehler's friend her card. Buehler says police prevented her from do so. Buehler says he would like for that woman to come forward as well.

When is some Presidential or Congressional candidate going to take up this issue? We need a national immunity law for the recording of public servants performing their job duties in public places. With specific prescribed penalties for violations.

And no, I don't expect any current Presidential candidate to make an issue of this.

Seems reasonable. You cannot take pictures of the King's guards. it says so right in the the dept's policy and procedures manual that no.

Why would I be proud? I have never defended cops. I have especially never defended bad cops. I hate cops.

But what I hate more than cops are people who salivate about raping and burning children. Over and over, repeatedly.

Well its about time that the lynch mobs come back... it could be in any form. The standard hood and torch mob that goes to these pigs homes at night pulls the vermin from their bed and lynches the ****er in a tree. Or it could be a more tactical modern variety of populous who get tired of the "qualified immunity" and their ilk making everything disappear after the evidence is present that they are liars. The modern look is a group of local populous getting geared up in tactical gear like the Stumble, Wave-Arms and Trip squads and no-knocks the vermin's home at the wee hours in the morning and pull them from their beds with guns pointed in each of the family members faces and lynches said vermin from the closest tree. Anyways my day dreaming is over and I am going to finish this fictional book in the near future... I hear that publishing is really cheap now.

A man who says he was arrested after photographing police conducting a drunken driving arrest early New Year's Day filed a formal complaint Monday against the officers. Antonio Buehler, 34, was arrested New Year's Day and charged with harassment of a public servant, a third-degree felony punishable by up to 10 years in prison. Officers said in an arrest affidavit that he interfered with a traffic stop at a 7-Eleven gas station in the 900 block of North Lamar Boulevard about 1:15 a.m. Jan. 1, becoming aggressive and spitting in the face of one officer before he was arrested. But Buehler, who said he is a West Point graduate and Iraq War veteran, tells a different story. He said the officers assaulted a woman involved in the traffic stop, then assaulted and arrested him under "false charges."

He is trying to get the charges dismissed, he said.

"I never spit on the guy, I never interfered with an arrest, and I wasn't drinking and driving," Buehler said. "The only thing I did was yell at them to stop assaulting her and take photos."

The complaint was filed Monday with the Office of the Police Monitor, which will begin an investigation into the incident. In August, the 1st U.S. Circuit Court of Appeals ruled that filming police in a public place is protected under the First Amendment. Buehler said he was sober and driving a friend home from a New Year's party when they pulled into the 7-Eleven to get gas and witnessed officers performing a sobriety test on a woman. He said they heard a scream as officers grabbed a woman out of the passenger's seat and held her arms behind her back while she knelt on the ground. Buehler said he and his friend started taking photos of the arrest, which prompted an officer to ask him why he was doing that.

The officer then pushed him against the truck, and Buehler held up his arms to show he wasn't a threat, he said. Buehler said he told the officer he had done nothing illegal, but the officer pinned him against the truck, saying Buehler spit on him. Buehler denies spitting on the officer. Buehler said he was then wrestled to the ground by the officers and arrested on suspicion of harassment. The driver of the car, Ashley Nicole Hill, was arrested on suspicion of driving while intoxicated, and her passenger, Norma Pizana, was arrested on suspicion of public intoxication, according to court records. Both crimes are misdemeanors. Pizana's attorney, Mindy Montford, said Monday that they have discussed filing a complaint of their own against the officers.

"We believe (the charge) is absolutely baseless," Montford said. She said the law says someone can be arrested for public intoxication if they are a danger to themselves or others, and Pizana was neither. The affidavit tells the arrest from the perspective of officer Pat Oborski, who stopped a car driving without headlights about 1:15 a.m. As Oborski was conducting a field sobriety test on the driver, her passenger kept yelling out of the window and "interfering with the investigation," the affidavit said.

Buehler said the woman was telling the driver not to take a breath test for blood alcohol levels.

Officer Robert Snider took the passenger out of the car to place her under arrest, the affidavit said. She went limp and fell to the ground, so the two officers stood her up and put her in handcuffs, the affidavit said. That's when a bystander, identified as Buehler, became "verbally aggressive," the affidavit said. Oborski went over to Buehler and told him not to interfere with the investigation, it said. The document said Buehler became confrontational and was "in (his) face." The two continued to argue, and Buehler spit in Oborski's face, the affidavit said.

Oborski tried to place Buehler under arrest on suspicion of harassment of a public servant, but he resisted; the two struggled physically, the affidavit said. That ended when Snider threatened to use a Taser on Buehler, the affidavit said. It also said Buehler resisted being put into a police car. A video filmed across the street by a bystander and posted on YouTube appears to show Buehler standing with his back against a pickup and talking to an officer with his arms outstretched. The officer approaches Buehler as the two argue, then he pulls at Buehler's arms before pulling him away from the truck and attempting to take him down to the ground. He brings him down as another officer runs up to them.

AUSTIN (KXAN) - A man who says APD brutally used excessive force on him says police won’t release the surveillance video of the incident.

Antonio Buehler says he received a letter Saturday from the Austin Law Department that was addressed to Texas Attorney General Greg Abbott. Buehler says in the letter the city’s legal department refuses to release the dash cam video, stating, "The department believes the release of the information represented by the enclosed records would interfere with these prosecutions. Thus, it is the department's position that the release of this information would interfere with the detection, investigation, or prosecution of crime, and the department seeks to withhold it section 552.108(a)(1)."

Buehler was arrested New Year's Eve off North Lamar after he stopped to take pictures of police stopping a woman suspected of DWI. Buehler believes officers were being overly aggressive toward the woman, so he took photographs. Officers said Buehler spit on them and was confrontational. Buehler believes the city is withholding the video to protect Officers Oborski and Snider because they were upset he was taking pictures, which is legal to do.

"I don't think police are bad, but there are some bad apples," said Buehler.

Video of the arrest, however, already exists. Another man passing by stopped, took video and then posted it to Youtube. KXAN attempted to reach the city’s legal department and as of publishing time have not heard back from any representatives. Corporal Scott Perry with the Austin Police Department told KXAN News “the case is still under investigation. We won’t release the dash cam until it runs its course through the legal system. ”

Buehler's request was denied as well as a requests by eight other individuals, including a worker at a local TV station.

"What is confusing to me is, why if it showed us doing anything, why withhold it?" Buehler questioned.

Buehler has filed a complaint, along with the woman facing a DWI charge, with the Austin Police Monitior and is calling on APD to launch an internal investigation. The police monitor has not yet responded to the complaints. He also thinks Officers Oborski and Snider should be placed on administrative leave until the investigation wraps up.

If the judge this case had any balls he would dress down the prosecutor in court and embarrass the piece of **** to the point that there will be contempt of court. But that would not make for good dinner party conversation within the after Nine crowd.

Antonio Buehler made his first court appearance Thursday morning at the Travis County Justice Complex, saying he looks forward to clearing his name. The Austin Police Department on Tuesday released dash cam video and audio from radios and 911 calls of the night that blogger Scott Henson was detained while walking with his 5-year-old granddaughter. Henson's post in his "Grits For Breakfast" blog garnered national and international attention last week when he said Austin police officers had roughly cuffed him and approached him with Tasers.

Police detained Henson, who is white, after receiving a 911 call Feb. 10 that a white man had kidnapped a black girl from the Millennium Youth Entertainment Complex in East Austin, Police Chief Art Acevedo said.

At a news conference Tuesday, Acevedo said his officers took the right measures in responding to a call about a possible kidnapping, acting in the interest of the child and without regard for Henson's socioeconomic status or race. The commotion could have been avoided, Acevedo said, if Henson had not walked away from the first officer to question him, a Travis County constable's deputy.

Henson said that after watching the video with Acevedo last week, he had made errors in his blog but was still critical of officers' response.

"Two departments with overlapping jurisdictions responded to this complaint: One came at us based on a community policing approach where she walked up calmly, asked a few questions, and according to her report was satisfied," Henson wrote in his blog. "By contrast, APD handcuffed first and asked questions later."
