CNN Legal Expert on Today’s Hearing: Obama Admin a ‘Train Wreck,‘ Obamacare Likely Will be ’Struck Down’

As Tuesday‘s hearing in front of the Supreme Court on Obamacare’s individual mandate wraps up for the day, the buzz is that things are not looking good for the Obama administration.

“This was a train wreck for the Obama administration. This law looks like it’s going to be struck down,” Jeffrey Toobin said on CNN. “All of the predictions including mine that the justices would not have a problem with this law were wrong.”

He continued: “The only conservative justice who looked like he might uphold the law was Chief Justice Roberts who asked hard questions of both sides, all four liberal justices tried as hard as they could to make the arguments in favor of the law, but they were — they did not meet with their success with their colleagues.”

That would be good if it were struck down...

We're in dire need of good news these days.

Yep. I think it's going to get blown up. I was not confident going into this, and the USSC surprises from time to time, but I'd give this 75+% odds of being killed.

What I want to see is which way the vote goes. Will there be a split? There shouldn't be.

I donno. At moments like this I'm reminded of the tales of one of the last Olympic Games where Nero participated in the chariot race drunk as a skunk, supposedly fell off his chariot more than once, finished dead last, and was rewarded with the laurel wreath of Victory (or whatever it was) while everyone else stood around and cheered... including the other participants because they knew what was good for them.

I mean, we're talking about them ruling against the President. This undermines his authority during the War on Terror AND it's an important piece of getting the Economy Back on Track!

Oh... I take it Justice Kagan is not recusing herself? Did it even come up? (And whose list did I just make for even asking that question...)

----------
It's not an issue of "cooperation" vs "go it alone": it's a question of involuntary vs voluntary relationships.

Reason: Kagan question

Has that ever happened?? A supreme court judge recusing himself from a case about an issue the president that nominated him being on the court???

I doubt it since there would be cases where there would only be a few judges ruling and it could lead to ties...

Kagan worked on the legislation itself.

Thomas recused himself over the women at VMI case because his son was a cadet at VMI at the time. So it does happen.

I expect some weird things to happen before this is all over. A sudden heart attack for one of the "conservative" judges is not out of the question.

Also I hate this whole conservative/liberal Justice thing. They are Justices' of the Supreme Court of the United States of America. They are supposed to be the most objective people in the country, free from bias and political motivations. Yet time and again we get 5-4 rulings suggesting that they are neither of those.

Didn't know that.

The press should ask for it... not that they will since they are a bunch of sellouts but eh... let's start the ball rolling.

Ruling is expected in June I think?

Is it like a line-item veto and the mandate clause is removed from law or is the entire act (whatever the name was) struct down in its entirety?

Depends.

The law is written so that if the mandate is struck the entire law SHOULD go. Who knows what the justices WILL do.

I won't believe it until I hear the ruling. I think they are just trying to look impartial; but when the vote comes, obamacare will stand. I hope I'm wrong; but I don't put my trust in much anything these days.

Either way they rule, there's gonna be hell...

Rule for it : it sets a precedent and screws everyone.

Rule against it : Obamabots are gonna go nuts and they will either ignore the ruling (you know they will try) or write even a worse bill (you know they will)... I can't see them dropping the issue.

Opinion will be issued in June.

NEVER, NEVER, EVER think you 'know' how SCOTUS is going to rule and you can NEVER successfully guess what way any of the Justices are leaning by their questions.

Most Justices use a very old method of measuring how well they agree with an argument by taking the OTHER SIDE of where they might normally lean.

Besides nuking it from orbit, it's the only way to be sure. smiley

isn't there a clause in the law that says it can never be repealed?

If this is so, isn't THAT in of itself unconstitutional?

Well... here's their plan if it gets thrown off the supreme court...

The single-payer plan reborn

How Obama could turn a health care defeat in the Supreme Court into a major progressive victory

Not surprisingly, Monday’s debut of Supreme Court argument over so-called “individual mandate” requiring everyone to buy health insurance revolved around epistemological niceties such as the meaning of a “fee” or a “tax.”

Behind all this is the brute fact that if the Court decides the individual mandate is an unconstitutional extension of federal authority, the entire law starts unraveling.

But with a bit of political jujitsu, the president could turn any such defeat into a victory for a single-payer healthcare system – Medicare for all.

This is what they gonna go for next.

Vitchilo yes, I think that is actually The Plan.
Supreme Court overturns it; but the opinion hints that as an alternative, they could create a complete government healthcare system, and tax the populace accordingly. Say hello to the DMW...Department of Medical Workers.
TSA misconduct? Pfffft. You ain't seen nothing' yet.

Isn't single payer Medicare for all what the intent of the HC Bill was in the first place? Mess up 17% of the economy, screw it up so poorly, that the result is everyone wants it fixed and they just blanket everyone with Medicare?
