If it is upheld it should be recorded as the official day that the Constitution died. While it has long been on life support this should be the final nail in the coffin. What they do after this will be a full blown police state with national ID's, no cash, etc.

I've been reading various tea leaf reading about this, and the latest is the SC watchers are convinced Roberts is writing the opinion and he and Kennedy are on the same side. This is based on a bunch of convoluted inside baseball stuff about precedence and who writes what and who assigns who to write what and all that good stuff. Roberts hasn't published any opinion for the last two months and that would make sense if he's been working on the majority Obamacare opinion for the last two months.

So thus, it will be either 5-4 to strike it down (to whatever degree, just the mandate, or the whole things, or anything in between) or 6-3 to uphold it all, with Roberts and Kennedy joining the 4 libs.

The argument for Roberts joining the libs to uphold is that he wants as a large a majority as possible and/or wants to limit it as much as possible by joining in and writing the opinion to uphold himself.

Another tea leaf in this direction is Scalia is grumpier than usual. They say for the last 10 years or so, he always gets really grumpy, writing fire and brimstone dissents on other cases when he loses the big one of the term. His Arizona law dissent definitely was pretty scathing and grumpy.

However, former clerks of Roberts don't buy he would go along with the libs for such cynical purposes on such a fundamental constitutional question.

And on the third hand, all of this could be wrong this time around, so who knows.

I think it's going to stand when the court punts and does nothing (but says that they won't do anything until some is actually "injured" by the law). SCOTUS doesn't care about the constitution. Just look at eminent domain decisions to see why. We're all being played by this "three card monty" system. Not sure why everyone thinks this other government entity is there to "save" you. It's not.

Latest is they think (Ruth Buzzi) Ginsburg is writing an Obamacare opinion as well. If that's true and Roberts is writing the other opinion, then it's certain to be 5-4 to strike down. Ginsberg is the most senior lib, so that would make her the one if Kennedy went with the conservatives.

I think Oblablah scolding the USSC was a tell that he was given a headsup that it was going down. So it was posturing/positioning for him. He'll be able to claim he did what was best in bringing the law and that he's needed to bring it back. SC is the scapegoat.
