Again, this just blows my mind. Of all the outcomes, this was one I wouldn't have guessed. Kennedy is usually the squish, the one who can go both ways, but this thing was so bad, he was *strongly* opposed to it, and pretty*****ed at Roberts.

I can't help but wonder if Roberts was threatened in some way by Obama and his cronies, and this wasn't just a case of him "evolving" to be liked by the NY Times and Washington Post and the Georgetown intelligentsia.

This opinion is such sophistry, such a bunch of BS, that I just wonder if something else was going on.

So was he teasing about needing to be somewhere safe, or was he attempting to send a message? What I've read of this opinion, it is an intellectual mess. Surely Roberts is capable of constructing something better if he wants to. It lacks rigor. If the "tax" wasn't cast as a tax in the House, can it stand constitutionally as a tax? That part should not have been left flapping in the breeze. It does almost seem as if it was written to be struck down.

if the law is un-severable, wouldn't the state Medicare unconstitutional decision make the rest of the law unconstitutional?

I too think that he my have been threatened. It is possible that he was told that if the law went down— the economy would collapse— the same 'tanks in the streets' argument that Paulson gave CONgress because if you all remember— this law WASN'T about Health care.

My mother is in her eighties and is so distressed by the Obamacare decision and the way it was done that she is nearly physically ill. She says that the whole thing makes no rational sense. There are too many lapses and inconsistencies. She is afraid that she is staring into the face of outright lawlessness on the part of the Supreme Court.

It is hard to disagree.

By definition if SCOTUS ruled in favour, it is not lawless.

It's The Law, it's Legal, and it's Constitutional.

When the institutions of a nation become corrupted, no legal code can fix the problem. If SCOTUS says something is Legal, it is.

The fix was in, no one can convince me that the republicans and the democrats alike needed another vehicle to suck resources out of the pockets of the producers. The dems can say, "wait a minute, we wanted a mandate, we never voted on a tax" and the republicans can say "we never saw the tax thing coming, we were fending off a mandate"

All the while Republicans are fighting to get a guy who pushed through the same system as gov. with the argument that we need to be able to control who gets seated on the supreme court (thank you Judge Roberts) and the dems are fighting to keep captain insano on power.

There is no way I am giving my consent to any of the organized mafia crime families, the Demonostras's, the Republicanti's or the Indepenziano's.

Every one of the ****ers want to shake their citizens down, some just more than others.

Since the other thread was locked, I'll throw my 2 cents here:


IF that's why he voted that way (and I have seen NO evidence that this is what happened), then he's not just a douchebag, he's a ****ing dangerously treasonous douchebag.

The ends do NOT justify the means. EVER. If it's unconstitutional - AND IT IS - SAY SO AND BE ****ING DONE WITH IT. NO ****** GAMES WITH THE ****** CONSTITUTION, ALL OF OUR LIVES (INCLUDING MY CHILDREN'S!), AND OUR REPUBLIC (such as it is).

And again - NO, I don't believe it for a second. But if it IS true... he's more dangerous than Obongo.

The latest is that sources inside the Court are confirming that the joint dissent was in fact Robert's original majority opinion to strike down the law before he flipped. Some were speculating if this was the case and it now look to indeed be so.

The four dissenters decided to leave Robert's own words in there as monument to his flip flop.

The question is who is leaking all this stuff. The clerks are held on a pretty tight leash about leaks, so it has to be a justice himself who is authorizing the leaks. There's a strong case that it's Kennedy, actually, it could well be all four of them decided to leak.

At any rate, this just hows how*****ed off Kennedy, Scalia, Thomas, and Alito are at Roberts.

He was writing the majority opinion to strike down Obamacare in its entirety, then flips at the last minute and writes this "it's a tax" nonsense.
