El Paso County Attorney Jo Anne Bernal said the banks created an electronic company that allows them to sell home mortgages to each other over and over again without recording it with the County Clerk's office. Bernal said not recording the newly acquired mortgages causes two different problems.

"One, the homeowner doesn't know who owns their mortgage," Bernal said. "Two, the county of El Paso -- and ultimately, the taxpayer -- don't receive the fee."

so many counties have been asleep at the wheel on this on all the recorder fees they missed out on... when they get desperate & the bloated gov unions start clamoring for revenue from anywhere, and start looking under sofa cushions, there may be more lawsuits like this...

Almost two years ago to the day, I marched into the chief deputy county clerk's office and explained what was going on with MERS and said that the county should try to find a way to get the records cleaned up and bring the recording fees in the door. The county clerk was out at the time, but she called me later the same day. We had a conversation and I emailed her information on MERS. She had never heard of MERS and knew nothing about it. I can't tell that anything changed, but at least she knows now. The recording fee here is only $20, so the integrity of the records is what counts more.

Texas bonds were rated AAA and were snapped up at auction at an insanely low yield. That would not have happened if the TBTF had arranged a buyer's strike -- and they would have if they had been made to do the right thing. The Obama administration was putting huge pressure on the state with required Medicaid expansion, air quality permitting, and endangered species designations. The AG has had his hands every day of the week suing the federal government. In fact, that is his job description as he reports it is speeches -- suing the federal government.

BTW, I also called the AG's office twice when the AGs first got together to deal with the mortgage situation. I wanted Greg Abbott and a couple of the other strong AGs to toss out the one who headed the coalition.

Azus, I've had a couple of meetings with county recorders as well. They know damn well what's going on at this point but are scared to death of the banks -- none have moved as of yet.

I'm continuing to work on it.

Same here in Michigan. The only County Recorder/Register of Deeds here in Michigan with real balls is in Ingham County. He did get the ball rolling on a lawsuit against MERS, which has now been joined by other counties, but, they're trying to work it to get to the banks/servicers because no one has any confidence that there is any money judgment that could be collectible against MERS. And they're certainly right to question that.

They know it here too. They need to be nudged a little more. Some counties people can just send in request to the county grand jury to look into it. I think more counties are catching on. This ball will get rolling fast. Shake the banker tree and $$$$ falls right into your counties lap.
