Gentlemen;

I am your constituent and reside at <elided>.

I write to you today related to the ongoing State of Emergency declaration by the Governor and the resulting power delegated to the County Mayors, specifically including Mayor Larry Waters of Sevier County.

As I'm sure you're aware in Nashville it has been reported in the media that the County Health Department deliberately concealed that less than 1% of their total Covid19 cases were able to be traced to hospitality businesses, specifically bars and restaurants. This was prior to the institution of mask orders.

Further, even a quick look at neighboring counties with mandates and not shows that if anything the correlation is negative -- that is, mandates are associated with more-severe spikes in Covid transmission. While correlation is not causation the lack of correlation is proof that the alleged causal event is in fact not responsible for the desired outcome. This is basic statistical analysis that anyone who ever takes a class in same learns within the first few weeks.

Other Governors have been caught on a "hot mic" admitting that the mask orders are all political theater, including Governor Wolf in Pennsylvania. In addition toward the end of that segment is the fact (by Dr. Oskoui, a relatively well-known cardiologist in the DC area) that we've known for 40 years that masks are worthless against viruses. He's right, and indeed even today the CDC has a page up on that analysis stating same.

Unicoi County just extended their order and explicitly stated in the extension itself that it was due to the impending flu season. In other words their extension had nothing to do with Covid at all. That's rank abuse -- and Unicoi is a bright red, Republican County, as is Sevier.

Dr. Fauci, Dr. Birx and others have intentionally falsified the evidence on pre-existing immunity -- but not by altering the evidence, simply by ignoring scientific papers published in the last several months documenting that somewhere around half of the population in fact has immune system recognition to Covid19 -- that is, it is not a "novel" virus in that not everyone is susceptible. Dr. Birx was just in Knoxville recently to advocate for more restrictions and tighter enforcement. She's lying and she knows it; she has the same data I do, and the correlation is simply not present to indicate any effectiveness of these orders. I direct you to Hawaii which put in place punitive arrival quarantines and mask mandates at the beginning of July and took a ten times Covid case rate spike in response.

I have modeled counties here in Tennessee and on a state basis and have yet to find a single instance in which the correlation has not held. In fact I predicated the point at which Sevier County would reach suppression levels in advance; we did, and I'd be happy to share the spreadsheet with you; all of the data in it is straight off official Tennessee records. In addition Sweden has clearly reached suppression as well, which would be impossible if their population was susceptible. This was known in March, incidentally. I request that you petition for the Governor to call the Legislature back in session and terminate all but the Emergency Declaration, and modify TCA as required so as to not only effect the immediate removal of such mandates from Sevier County, where I live, but also to Knox, Nashville, Memphis and other parts of the state. What is going on now is abusive, arbitrary and outrageous, it is doing severe damage to local and state businesses, and it must not stand.

I realize that Governor Lee wants to keep the "Emergency" declaration because doing so keeps Federal Funds available. With this I have no complaint. But the remaining constraints, particularly the implied threats in the "Tennessee Pledge" (which some local health departments, including Sevier County's, have been used as a cudgel at local businesses despite the explicit statement by the Governor that they are in fact suggestions without force of law), the Mask Mandate authority and, in Knoxville, Nashville and Memphis, the crushing business constraints are unconscionable.

Covid can be a serious disease, but the CDC's own fatality estimates are below that of the Social Security Administration for persons in the same age bracket. SSA produces a table that gives you one survival odds for a person of "X" years. The Covid infection fatality rate is below that number. In addition in counties such as Knox and Sevier the hospitalization rates have never proved to be a material burden -- in this county, for example, the 7 day run rate has never exceeded two per day and fatalities are approximately equal to the flu in burden when adjusted for a full 12-month year and compared against historical averages.

Meanwhile the constraints have caused large spikes in both ODs and suicides. As I'm sure you would agree dead is dead, irrespective of the reason. The alleged "saving one life" argument is void if your "saving" actions kill 20 people through drug overdoses and suicides as their jobs and ordinary human social interaction have been maliciously destroyed. The burden of these constraints falls almost entirely on the lower rungs of the economic ladder. I'm retired and have no financial interest in this being rectified immediately but I have friends who are being smothered on a daily basis yet don't dare complain as "it's a mandate" and they'll get fired immediately if they refuse. These mandates are strangling people on the lowest rungs of the economic ladder who cannot afford to complain or quit.

I have spoken at the County Commission meeting on this matter and have been ignored. I have also sent multiple letters with stamps on them, along with electronic correspondence, and have received no response to any of them from my local County officials. As my State Representatives in the Tennessee House and Senate it is now time for me to turn to you.

Executive Action capacity exists due to the potential for exigent circumstance. Seven months into Covid19 any claim of exigence fails to pass the giggle test and is an outrageous fraud upon the people of this State. The correct action is to limit any Executive Action by the Governor or Mayors that impose constraints on the people or businesses of Tennessee in the event of emergency, including but not limited to the current Covid19 situation, to no more than 30 days after it begins beyond which the Legislature must act to debate, vote on and pass whatever relief someone wishes to continue. Without said concurrence said authority automatically lapses. This would, upon passage, immediately void all such orders other than the Declaration of a "State of Emergency", which has as its only effect enabling receipt of federal funds.

This is a change in TCA that can be made now and will stop all of this nonsense, void the existing orders and return authority for these types of actions should they truly be necessary in the future to where it belongs -- in the House and Senate, after a full debate and vote.
