But I do want to stress that no one need get "depressed". In the grander scheme of things, what is going to happen is the best for this country. Will get the USA back to basics. The problem is, if you edit content, you violate your "common carrier" status and are now directly responsible for ALL the content. I'm not sure how this is being handled. It says "pressure" from the New York AG. Why wasn't this just done by a court with a restraining order?

Those Internet Companies might end up getting sued in the legal limbo like the phone companies who cooperated with the requests from the Federal Government to wire tap without a warrant. Or worse, the executives held accountable for all the content because they exercised editorial privilege.

The facts are that it doesn't work like that. I've been involved in this industry for a VERY long time and there are limits to this claim of "common carrier status".

There is no "common carrier" defense available to UPS if they start carrying boxes that have "CHILD PORNOGRAPHY" printed on the outside!

BTW, the statistics are that 80% of the traffic is contained in groups that are carrying binaries, and 95% of the binary content is illegal - its either kiddie porn or ripped off.

Boz, Gen's right. You simply tell the news server not to pull certain groups. It's pretty hard to defend why you chose to leave Alt.binaries.pictures.erotica.child.female on the server. I'd hate to be the one to tell someone they lost their common carrier status because they removed kiddy porn from their news server... Bottom line is that it's illegal and for anybody that makes a stink you just refer them to the local FBI office and tell them that if they can convince the FBI to allow it, you'll allow it...

News servers are mostly-analagous to a library or newsstand. You didn't write the material but it is categorized by a "Dewey Decimal System" and you can choose what numerical codes you're willing to accept or not.

Your choice of which Dewey Codes you accept doesn't impact whether or not you're responsible for the material in a given book. You're not, so long as you don't have actual, constructive notice of what's in a given book. If you are notified that a given book has illegal material in it, you are required to remove it when notified.

Now when you can convince a court that you can have a section in the library called "Child Pornography", that actually contains what the label says, and then can hide behind "specific notice requirements", I'm willing to accept the argument.

There's not a snowball's chance in Hell that argument will fly in court.

Boz, what that article mentions is scanning for kiddy porn. That's not the same as what I'm talking about. For usenet groups you can tell the server not to pickup the content. You're not editing it, you're not scanning it, you're just not carrying it.

Now the way around that is for the perv's to connect to a news server over in eastern europe or somewhere else where they look the other way. Now if you sniff nnpt packets then you run afoul of the law mentioned in the article
