I listened to an attorney knowledgable on the application of SYG law in Florida while interviewed on the radio. She said that over 70% of SYG mini-trials prevail in favor of the defendants in Florida. She said that George Zimmerman would have to testify on his own behalf and that anything he testified to would be open game for use later if the case went to full trial. She gave the impression that GZ's word on the stand would be critical since he was the only real witness to what occurred (note: I thought another independent witness saw GZ on the ground) and that since GZ was caught in a lie with regard to cash assets available that it could tarnish his credibility on the stand. And the same judge who he reportedly lied to is the same judge who will be hearing the SYG mini-trial. She said that in such a heated case, politically and racially, the judge could likely rule that not enough evidence exists to rule on SYG in the GZ case and could defer to the jury to make the final call after listening to all the evidence. I tend to agree with her here. This potato may well be too hot for the judge to handle. She also said that there may be some question as to who instigated the altercation and if the judge rules that the evidence fails to provide sufficient proof that Martin did - GZ loses. She did not mention whether the SYG ruling is based on preponderance of the evidence. If so, that would really favor GZ. My belief is that if GZ were an unknown defendant and this case was not so racially charged that it would be practically a slam-dunk for the defense. But based on what I have already read and heard - from court officials and the media - IMO the odds are heavily favored to the side of the prosecution here. Justice is not blind. It's grossly nearsighted most of the time.
