News servers are mostly-analagous to a library or newsstand. You didn't write the material but it is categorized by a "Dewey Decimal System" and you can choose what numerical codes you're willing to accept or not. Your choice of which Dewey Codes you accept doesn't impact whether or not you're responsible for the material in a given book. You're not, so long as you don't have actual, constructive notice of what's in a given book. If you are notified that a given book has illegal material in it, you are required to remove it when notified. Now when you can convince a court that you can have a section in the library called "Child Pornography", that actually contains what the label says, and then can hide behind "specific notice requirements", I'm willing to accept the argument.
