News servers are mostly-analagous to a library or newsstand. You didn't write the material but it is categorized by a "Dewey Decimal System" and you can choose what numerical codes you're willing to accept or not.|
Your choice of which Dewey Codes you accept doesn't impact whether or not you're responsible for the material in a given book. You're not, so long as you don't have actual, constructive notice of what's in a given book. If you are notified that a given book has illegal material in it, you are required to remove it when notified.
Now when you can convince a court that you can have a section in the library called "Child Pornography", that actually contains what the label says, and then can hide behind "specific notice requirements", I'm willing to accept the argument.
There's not a snowball's chance in Hell that argument will fly in court.
