I have no sympathy for the borrower but the argument for a two-tier system of justice stands on its own.

snip wrote..
“The Department of Justice has made prosecuting financial crimes, including mortgage fraud, a high priority,” said Neil H. MacBride, the United States attorney for the Eastern District of Virginia, in a statement.

Apparently, though, it’s only a high priority if the target is a borrower. Mr. Mozilo’s company made billions in profit, some of it on liar loans that he acknowledged at the time were likely to be fraudulent and which did untold damage to the economy. And he personally was paid hundreds of millions of dollars. Though he agreed last year to a $67.5 million fine to settle fraud charges brought by the Securities and Exchange Commission, it was a small fraction of what he earned. Otherwise, he walked. Thus does the Justice Department display its priorities in the aftermath of the crisis.

" Mr. Nordlander later told the grand jury, “Being the special agent that I am, I was wondering, how does a guy train for this because most people have to work from nine to five and it’s very difficult to train for this part-time.” (He also told the grand jurors that sometimes, when he sees somebody driving a Ferrari, he’ll check to see if they make enough money to afford it. When I called Mr. Nordlander and others at the I.R.S. to ask whether this was an appropriate way to choose subjects for criminal tax investigations, my questions were met with a stone wall of silence.) "

I have sympathy for the borrower. He's in jail for having his broker fraudulently fill out and fake a signature on loan docs, while he broker got cut a deal for testifying against the guy.

He got hunted down by an IRS agent merely for being seen in a movie.

He's watching thousands if not millions of people who did exactly what he did (which was just ride a bubble), profited more from what he did, committed actual crimes, and much more be free to keep living their lives.

The Tan Man walks while this guy rots.

Even when he emerges from prison, though, his ordeal will not be over. As part of his sentence, Mr. Engle was ordered to pay $262,500 in restitution to the owner of his mortgages. And what institution might that be? You guessed it: Countrywide, now owned by Bank of America.

Can this be discharged in bankruptcy? I'd be real motivated to find a way not to pay.

It's this sort of situation that strengthens my belief in defending small-time legal infractions, so that I can get exposure to and some understanding of the legal system and the rules of evidence.

Know your enemy. The lawyers/attourneys are not on your side, even though you pay them for their services. Bar members are first and foremost officers of the court.

Why do you complain? It's the criminals who decide how proceeds of crime are spent, not the victims.

I'd be interested in how ****ty his attorney(s) were, and how ****ing stupid the jury was. Perhaps it was a case of jealousy that a guy used money he didn't actually earn to go out and literally run all the time with no effort to pay it back. The hypocrisy of it all boggles the mind though.

Elsewhere (another blog) - it was suggested someone had a personal vendetta against this guy.

Two tier ? That is the minimum. You are forgetting the other tiers for the government, and the other special tier for cops. That is two more right there

This is called "lifestyle profiling" and the IRS has been doing that since the Clinton years.

and how is this not abuse of power?

if i look up a patient's account without a specific reason, it is a HIPPA violation and grounds for termination.

how do you even know the guy driving the ferrari isn't borrowing it from a friend?
